These Terms of Service (“Terms”) govern your use of Mockly's website, application, and services (collectively, the “Service”), operated by MocklyAI Ltd (“Mockly,” “we,” “us,” or “our”).
By accessing or using Mockly, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account or using Mockly in any way, you represent that you are at least 16 years old. If you are under 18, you acknowledge that Mockly applies additional protections to your data as described in our Privacy Policy.
If you are using Mockly on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Service Description
Mockly is an AI-powered interview practice platform. The Service allows you to:
- Conduct mock interviews with AI-generated questions tailored to your career stage and sector
- Record video and audio of your practice interviews for your own review
- Receive AI-generated transcripts, performance scores, feedback, and coaching recommendations
- Track your performance over time and work toward personalised goals
Important Limitations
Mockly's feedback is generated by artificial intelligence. It is designed to help you practise and improve, but it is not a substitute for professional career coaching, recruitment advice, or legal advice. We do not guarantee job offers, interview success, or employment outcomes. AI feedback may occasionally be inaccurate or incomplete.
3. User Accounts
3.1 Account Creation
To use Mockly, you must create an account with accurate and current information. You must accept these Terms and our Privacy Policy before your account becomes active.
3.2 Account Responsibility
You are solely responsible for all activity under your account. You agree to:
- Maintain the confidentiality of your password and credentials
- Notify us immediately of any unauthorised access or security breach
- Keep your account information accurate and up to date
- Not share your account with others or use another person's account
3.3 Account Suspension or Termination
We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct. Upon termination, your right to use the Service immediately ceases. You may also delete your own account at any time via the dashboard.
4. Acceptable Use Policy
You agree not to use Mockly for:
- Any activity that violates applicable UK or international laws
- Threatening, harassing, defaming, or abusing other users or Mockly staff
- Misrepresenting your identity or providing false information
- Attempting to gain unauthorised access to Mockly's systems, other users' accounts, or data
- Uploading or transmitting malicious code, viruses, or malware
- Attempting to manipulate, bypass, or inject instructions into Mockly's AI systems (including prompt injection attacks via CV uploads or job description inputs)
- Uploading sexually explicit, violent, hateful, or discriminatory content
- Using Mockly for commercial purposes without authorisation (including reselling access or scraping data)
- Sending unsolicited messages, advertisements, or promotional content through the platform
Violation of this policy may result in immediate account suspension or termination without refund.
5. Intellectual Property Rights
5.1 Mockly's Intellectual Property
All content, software, features, and functionality of Mockly, including the platform design, AI algorithms, grading systems, prompts, feedback mechanisms, and branding, are owned by Mockly or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use Mockly for personal, non-commercial purposes only.
5.2 Your Content
Ownership: you retain ownership of content you upload to Mockly, including CVs, job descriptions, and interview responses.
Licence to Mockly: by uploading content, you grant Mockly a worldwide, royalty-free licence to use, copy, and process your content for the purposes of delivering the Service to you, including generating questions, producing transcripts, grading your answers, and storing recordings for your replay.
Transcript improvement (opt-in only): if you separately opt in (during onboarding or in your account settings), you additionally grant Mockly permission to review your interview transcripts to improve our question prompts and grading rubrics. This opt-in covers transcripts only, never video or audio recordings. You can withdraw this consent at any time. This opt-in is not offered to users under 18.
5.3 Interview Recordings
You own your interview recordings. Mockly stores video and audio recordings so you can replay your interviews alongside your feedback. Video and audio are automatically deleted after 1 year. You can also delete any individual interview at any time via the dashboard.
Mockly does not use your video or audio recordings for product improvement, AI training, or any purpose other than providing the replay feature to you. We will not publicly identify you or share your specific recordings with any third party without your explicit consent.
6. Subscription Plans and Payment
6.1 Free and Pro Tiers
Mockly offers a free tier with limited usage and a paid Pro tier with full access. Current pricing is displayed on the pricing page at mocklyai.co.uk/pricing. Features and limits for each tier are described on that page.
6.2 Billing
Paid subscriptions are billed monthly or annually, depending on your selection. Payment is processed by Stripe. By providing payment information, you represent that you are authorised to use that payment method and you authorise Mockly to charge your payment method for your subscription.
6.3 Refund Policy
No discretionary refunds are offered for subscription fees. When you subscribe, you are purchasing access to the Service for the billing period selected.
This does not affect your statutory rights under UK consumer law. If you believe you are entitled to a refund under applicable consumer protection legislation, contact us at contact@mocklyai.co.uk.
6.4 Cancellation
You can cancel your subscription at any time through the Stripe Customer Portal (accessible from your dashboard). Cancellation takes effect at the end of your current billing period. You retain full Pro access until then. No refund is issued for the remaining period.
6.5 Price Changes
We may change subscription prices with at least 30 days' notice. We will notify you by email before any price change takes effect. If you do not agree with a price change, you may cancel your subscription before the new price applies.
7. Limitation of Liability
7.1 Disclaimer of Warranties
Mockly is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted or error-free
- AI-generated feedback will be perfectly accurate or lead to job offers
- The Service will meet your specific requirements
- Defects will be corrected within any particular timeframe
7.2 Limitation of Damages
To the maximum extent permitted by applicable UK law, Mockly shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, revenue, data, or business opportunities
- Damages arising from your use of, or inability to use, the Service
- Damages exceeding the total amount you have paid Mockly in the 12 months preceding the claim
This limitation applies regardless of the theory of liability and even if Mockly has been advised of the possibility of such damages.
7.3 Statutory Rights
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable UK law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8. Indemnification
You agree to indemnify, defend, and hold harmless Mockly, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable laws
- Your infringement of any third-party rights
- Content you upload to Mockly
9. Data and Privacy
Your use of Mockly is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
The Privacy Policy describes what data we collect, how we use it, who we share it with, how long we retain it, and your rights regarding your data.
10. Modifications to the Service
We may modify, update, suspend, or discontinue the Service (or any part of it) at any time. We will make reasonable efforts to notify you of material changes. We are not liable for any modification, suspension, or discontinuation of the Service.
11. Third-Party Links and Services
Mockly may contain links to third-party websites and services. We are not responsible for their content, accuracy, or privacy practices. Your use of third-party services is governed by their own terms and policies.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales.
12.2 Jurisdiction
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12.3 Informal Resolution
Before bringing any formal claim, you agree to first contact us at contact@mocklyai.co.uk and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mockly regarding your use of the Service. Any prior agreements, understandings, or representations are superseded by these Terms.
15. Waiver
Mockly's failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or any other provision.

17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of Mockly after changes take effect constitutes acceptance of the updated Terms.
